Sanford, FL Noise Ordinances: Construction Hours (2026)

Section 38-74(1) of the Sanford City Code flatly bars operating or permitting the operation of 'any tools or equipment in construction, drilling, or demolition work of any type or nature' between 10:00 p.m. and 7:00 a.m., with an exception only for emergency work and for any contractor who obtains the permit described in subsection (2). To get that permit, a contractor applies to the city's administrative official and must show 'by clear and convincing evidence' that extending the hours will not materially harm public health, safety, and welfare, that there are bona fide construction requirements supporting the extension, and that the city will realize an economic benefit from the extended hours.

An approved permit spells out the specific days the time limit may be exceeded, the extended time frame, and how long the permit lasts. The section builds in a strong compliance incentive: the permit itself provides for immediate revocation, and continuing work outside the approved hours after revocation carries a built-in 'consent to an immediate code enforcement fine.' Outside of a permit, a construction-hours violation is treated like any other breach of the noise article, chapter 38, article III: it can draw a written warning under § 38-77 before a citation issues, and once a case reaches the special magistrate or county court, § 38-84(3) sets a minimum fine of $500.00, with each day of continued after-hours work chargeable as a separate offense.
