Fauquier County, VA Noise Ordinances: Decibel Limits (2026)

Section 13.5-3(a) sets two independent tests for residential noise: a sound is a violation if it is plainly audible inside another person's residence at least four feet from the nearest wall with doors and windows closed, OR if it exceeds 65 dBA in daytime hours or 55 dBA at night when measured at the noise emitter's property line or any point on another affected property. The code states these are 'distinct and independent grounds for enforcement,' so a sound violating either standard is unlawful regardless of the other.

Measurements use an integrating sound level meter meeting Va. Code §§ 19.2-270.7 and 2.2-1112 standards, held four to five feet above ground and read over five continuous minutes (or during the burst for an 'impulse sound' like a gunshot or drumbeat, as the zoning administrator determines). A plainly-audible violation needs no meter at all. Violations under Chapter 13.5 carry a civil penalty of $250 for a first offense and $500 for each later offense under § 13.5-2, and the county may also seek an injunction in circuit court.

The chapter can be enforced by the county administrator, county attorney, commonwealth's attorney, the Sheriff, any deputy or animal control officer, and a private citizen may seek a magistrate's summons without needing Sheriff's office corroboration.
