Outdoor music in Upland is regulated through the general noise standards rather than a standalone outdoor-music or entertainment-permit chapter. Section 9.40.100(B) makes it unlawful to play any musical instrument, stereo, phonograph, or amplifying device when audible 50 feet or more from the source or audible within another residence or establishment, which directly reaches backyard parties, patios and outdoor speakers. Section 9.40.100(D) separately makes it unlawful to use any drum, other percussion instrument, or musical instrument or device to attract attention by creating noise within the city. On top of these, the base ambient levels in Section 9.40.040 apply at the property line (55 dB(A) residential by day, dropping to 45 dB(A) from 10 p.m. to 7 a.m.), and the Section 9.40.070 duration table limits how long louder bursts may last. Live or amplified outdoor music that crosses those thresholds, or that is otherwise a loud, unnecessary or disturbing noise under Section 9.40.060, can be cited. A key exception appears in Section 9.40.100(Q): the prohibited-noise provisions do not apply to participants in events for which a valid city permit has been obtained and the conduct authorized, which is how festivals, fairs and similar sanctioned events operate. As an incorporated city, Upland applies these rules, not San Bernardino County's unincorporated-area noise code.
Outdoor music audible 50 feet from the source, using drums or instruments to attract attention, or exceeding the Section 9.40.040 limits is a misdemeanor under Section 9.40.110 (up to $1,000 / 6 months, each day separate) unless covered by a valid city permit under Section 9.40.100(Q). Repeat disturbances may be abated as a public nuisance under Section 9.40.130.
