Construction hours in Upland, CA — sometimes called construction noise rules or contractor work-hour ordinances — set when contractors can run power tools, hammers, and heavy equipment.
In the City of Upland, Municipal Code Section 9.40.100(M) makes it unlawful to erect, excavate, demolish, alter or repair any building other than between 7 a.m. and 6 p.m. on weekdays, except in an urgent public-health emergency under a building-inspector permit. The code does not provide a separate Saturday or Sunday construction window.
Construction noise in Upland is governed by Section 9.40.100(M) of the Municipal Code. It is unlawful to engage in or permit the erection (including excavation), demolition, alteration or repair of any building other than between 7 a.m. and 6 p.m. on weekdays, except in case of urgent necessity in the interest of public health and safety, and then only with a permit from the building inspector. Such emergency permits run no more than three days and may be renewed in three-day increments while the emergency continues. If the building inspector determines public health and safety would not be impaired, and that loss or inconvenience would otherwise result, the inspector may grant written permission to work between 6 p.m. and 7 a.m. As written, the ordinance limits the standard allowance to weekdays and does not spell out a Saturday or Sunday window, so work outside the weekday 7 a.m.-6 p.m. hours generally requires that inspector authorization. A related provision, Section 9.40.100(O), separately bars operating any steam shovel, pneumatic hammer, derrick, or steam or electric hoist between 10 p.m. and 7 a.m. This is the city's own rule and is stricter in scope than relying on San Bernardino County construction-hour limits, which apply only to unincorporated county areas.
Construction outside the permitted hours without building-inspector authorization violates Section 9.40.100(M) and is a misdemeanor under Section 9.40.110: up to a $1,000 fine, up to six months in jail, or both, with each day a separate offense. The work may also be abated as a public nuisance under Section 9.40.130.
