Reflecting Upland's history with sand-and-gravel and construction-material operations, Section 9.40.090 sets a detailed mining-industry standard: at residential property lines, allowed average exterior sound is 55 dB(A) during defined daytime operating windows (for example quarry/plant 6 a.m.-6 p.m. Monday-Friday, 7 a.m.-3 p.m. Saturday) and 45 dB(A) at all other times, with strict measurement, calibration and record-keeping procedures. Loading and unloading noise is separately restricted under Section 9.40.100(L). These city standards apply within Upland; San Bernardino County's noise rules govern unincorporated areas only.
Industrial or commercial noise exceeding the Section 9.40.040 ambient levels, machinery exceeding ambient by 5 dB(A) under Section 9.40.100(E), or mining operations exceeding the Section 9.40.090 limits, is a misdemeanor under Section 9.40.110 (up to $1,000 / 6 months, each day separate) and can be abated as a public nuisance by injunction under Section 9.40.130.
