Escondido's noise curfew operates on a presumption, not a meter reading. m. If a stereo, radio, television, cassette or CD player, musical instrument, or connected sound amplifier is plainly audible 50 feet from the building, structure, or vehicle where it is playing, or produces vibration a person can feel at 50 feet, that fact alone is prima facie evidence the operator has violated the noise article. 5 may impound a vehicle carrying the equipment if it cannot be removed without damage. During daytime hours the same devices are instead governed by the general 'uses restricted' standard and the numeric limits of Table 17-229, which separately sets nighttime ambient caps as low as 45 dB in residential zones.

Violations of Article 12 overall, including the curfew provision, are misdemeanors under § 17-244, punishable by a fine of up to $1,000, up to six months in jail, or both, with each day of continued violation a separate offense. The building director and chief of police split enforcement between environmental and nuisance noise complaints, and a property owner can request a variance from the city manager under § 17-249 if compliance requires time. The curfew applies whether the sound source is fixed in a home or mobile in a vehicle, and it complements rather than replaces the numeric sound-level limits that already apply throughout the day.
