Perth Amboy, NJ Noise Ordinances: Quiet Hours (2026)

Article III of Chapter 304 of the Perth Amboy City Code, adopted October 3, 1951 as Ord. No. C-449, is the city's unnecessary noise article. Section 304-8 declares that loud, unnecessary or unusual noises affect the health, comfort, safety and welfare of residents of the City of Perth Amboy, and § 304-9 makes it unlawful to make or continue any loud, unnecessary or unusual noise that annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others within the city limits. Section 304-10 then lists acts declared to be unnecessary noises, and the list is expressly not exclusive.

The night-time triggers sit inside that list. Under § 304-10(B), operating a radio, musical instrument, phonograph, electronic device or other sound machine between 11:00 p.m. and 7:00 a.m. so that it is plainly audible at a distance of 50 feet from the building, structure or vehicle in which it is located is prima facie evidence of a violation. At any hour, the same subsection reaches sound louder than necessary for convenient hearing by the voluntary listeners in the room or vehicle.

Section 304-10(D) covers yelling, shouting, hooting, whistling or singing on the public streets, particularly between 11:00 p.m. and 7:00 a.m., or at any time or place so as to annoy or disturb persons in an office, dwelling, hotel or other residence. Section 304-10(P) sets a hard window for heavy equipment: the operation between 10:00 p.m. and 7:00 a.m. of any pile driver, steam shovel, pneumatic hammer, derrick, steam or electric hoist or other appliance attended by loud or unusual noise.

Vessels have their own hours. Under § 304-10(R), personal or commercial vessel music equipment or any loud or unusual noise cannot be plainly audible at 25 feet in any direction from the operator between 10:00 p.m. and 8:00 a.m. Under § 304-10(S), the distance is 50 feet between 8:00 a.m. and 10:00 p.m. Chapter 304 does not use a single blanket curfew clause, so the hour that applies depends on which subsection the conduct falls under.
