Montebello Municipal Code Section 9.08.050 bars unnecessary horn use and disturbing noise from defective or overloaded vehicles, while Section 9.28.020 makes it unlawful for any vehicle alarm to sound for more than five minutes.
Montebello addresses vehicle noise in two places. Section 9.08.050(A) declares it loud or raucous to sound any horn louder or longer than reasonably needed to warn of danger, or to use a horn or whistle for an unreasonable period. Section 9.08.050(G) covers any motor vehicle so out of repair, so loaded, or operated so as to disturb a reasonable person. Section 9.08.030 defines motor vehicle to include mini-bikes, go-carts, automobiles, trucks and off-highway vehicles. Separately, Chapter 9.28 governs motor-vehicle alarms: Section 9.28.020 bars any vehicle alarm sounding within the city for more than five minutes; Section 9.08.040(C) exempts alarms terminated within five minutes. Exhaust and muffler noise is regulated statewide by the California Vehicle Code (Sections 27150-27151).
Excessive horn use or a defective/overloaded vehicle disturbing neighbors violates Section 9.08.050 and, under Section 9.08.060, is a misdemeanor or infraction. A vehicle alarm sounding over five minutes violates Section 9.28.020. Exhaust violations are cited under the California Vehicle Code.
