No person shall drive or move or cause or knowingly permit to be driven or moved a motor vehicle or combination of vehicles at any time in such a manner as to exceed the following noise limits for the category of motor vehicle shown below. Noise shall be measured at a distance of at least 25 feet (seven and one-half meters) from the near side of the nearest lane(s) being monitored and at a height of at least four feet above the immediate surrounding surface. (c)No person shall operate or cause to be operated any motor vehicle unless the exhaust system of such vehicle is: (1)Free from defects which affect sound reduction; (2)Equipped with a muffler or other noise dissipative device; and (3)Not equipped with any cut-out, bypass or similar device.

Sec. 5-28 of the Cumberland County Code of Ordinances sets two distinct rules for vehicle noise. Subsection (a) caps sound measured 25 feet from the nearest lane and four feet off the ground: ordinary vehicles cannot exceed 76 dB(A) at speeds of 35 mph or less, or 80 dB(A) above 35 mph; heavier vehicles rated at 10,000 pounds gross weight or more, other than those run by interstate motor carriers, top out at 91 dB(A) and 95 dB(A) for the same speed bands. ' Subsection (c) is a separate equipment mandate, applying regardless of the decibel reading: every motor vehicle's exhaust system must be free from defects that affect sound reduction, fitted with a working muffler or other noise-dissipative device, and must not carry any cut-out, bypass, or similar device that lets exhaust bypass the muffler. Subsection (b) clarifies the noise cap applies to the vehicle's total noise output and does not limit enforcement of any other muffler-related provision in the article. The Cumberland County Sheriff's Office enforces both the decibel limits and the equipment mandate under Sec. 5-31, and can stop and cite a vehicle for either violation independently.
Violations & Fines
A vehicle noise violation under Sec. 9.5-28 carries the same schedule as the rest of the noise article: a $100 civil penalty for a first offense under Sec. 9.5-32(a)(1), rising to $150 for a repeat within 12 months, payable within 72 hours.
