Lenexa, KS Outdoor Cooking: Smoker Rules (2026)

Section 3-5-D-3 of the Lenexa City Code exempts two activities from the open burning permit requirement in Article 3-5-D. The second, subsection B, is the use of a grill or outdoor cooking appliance at one- and two-family dwellings. Three conditions come attached: the appliance is used in accordance with the manufacturer's instructions, it is not used to burn refuse, land clearance materials or similar items, and it does not cause an unreasonable nuisance or annoyance or unreasonably interfere with the enjoyment of life or property. The code never uses the word smoker; cooking equipment is covered by the phrase grill or outdoor cooking appliance, so the same three conditions are the test.

The exemption is written only for one- and two-family dwellings. Section 3-5-D-2-A requires anyone who wants to conduct open burning, except as exempted under Section 3-5-D-3, to get a permit from the Lenexa Fire Department, so the exemption text does not extend to other property types. Section 3-5-I-4 defines open burning as igniting, burning or smoldering any material where combustion emissions go into the ambient air without passing through a stack or chimney, and defines firewood as natural wood that is not sawn lumber, painted, varnished, coated or pressure treated.

Subsection A of the same section exempts recreational burning and portable outdoor fireplaces at one- and two-family dwellings, but only if they meet the requirements of Section 3-5-D-2-B-6, including the 15 foot distance from structures, vehicles and combustible material. That distance is written for recreational fires and portable fireplaces, not for cooking appliances, so cooking is judged by the manufacturer's instructions and the nuisance test. Section 3-5-D-2-D separately bars burning any man-made material, including refuse, plastics and lumber, and bars flammable liquids as an accelerant. Section 3-5-D-5 lets the Fire Chief or designee extinguish any burn without prior notice when it is not being conducted in compliance or represents a hazard.
