03(j), within the Development Code's off-street parking chapter, restricts which commercial vehicles can be parked or stored on residential lots. 03(j)(1) limits outdoor parking or storage on a residential lot to vehicles classified as Class 1, Class 2, or Class 3 light-duty vehicles under the Federal Highway Administration's vehicle classification system; every heavier classification of commercial vehicle may only be parked or stored on a residential lot when it is inside a fully enclosed building. 03(j)(2) carves out a practical exception so the rule does not stop everyday residential activity: the outdoor-storage prohibition on heavier vehicles does not apply to commercial vehicles that are delivering goods to a residence, present for a service call, present for construction on the site, or engaged in other similar activities where a commercial vehicle is required.

03(h) (private residential parking areas must be paved with a durable, dustless surface) apply to any residential lot parking under this Development Code chapter generally. Because the rule is a Development Code provision, the Development Code Administrator enforces it, with authority to issue civil citations or refer the matter for criminal prosecution under Chapter 1228: a $150 civil penalty for a first citation and $250 for each subsequent citation within three years, or misdemeanor charges of the third degree on a first offense rising to the second degree for repeat offenses, with each day a heavier commercial vehicle remains parked outside a fully enclosed building on a residential lot counted as a separate violation.
