Ordinance TC-3452 created OPMC 12.04.085.3, barring anyone from occupying or obstructing a designated electric vehicle charging stall unless the vehicle is plugged in. It reaches private lots as well as City lots, but only where the notice language in subsection (b) is posted at each stall. Fines run $100 to $1,000, rising to $250 and $500 minimums for repeat offenses, with no suspension. For home installation, Appendix V of the City residential code defines an EV Ready Space as one served by a dedicated 40-ampere, 208/240-volt branch circuit. Kansas Statutes Chapter 58, including the Common Interest Owners Bill of Rights Act at Article 46, contains no charging provision, so HOA covenants control.
Minimum $100 fine on a first conviction, $250 on a second within twelve months, $500 on a third within twenty-four months; maximum $1,000, and minimums cannot be suspended.
