Full Breakdown

Loading space rules appear twice in section 12-432 of the Bonner County Revised Code. Standard 3 under Table 4-3 says industrial, institutional and commercial uses shall be provided with off street loading spaces, exclusive of access areas, of not less than 12 feet in width. Subsection C repeats the rule for commercial uses with the figure written as twelve feet (12') in width. Both versions end with the same limit: loading spaces shall not project into public rights of way or setback areas. A truck bay that sticks out into the road right of way or into the required setback does not comply.

Table 4-3 tags standard (3) to convalescent centers, golf courses (excluding clubhouses), hospitals and the school categories, so institutional sites carry the loading requirement along with their parking counts. Section 12-432 B adds that off street parking areas must include adequate stopping or parking areas for service vehicles, as specified in subsection C, and that the planning director determines the minimum requirements for service vehicles, and for a use not referenced in the table, based on the most comparable use under the Standard Industrial Classification Manual or the North American industry classification system.

Section 12-420 B closes a loophole: no part of an off street parking or loading space required for one building to comply with the title can be counted toward the same requirement for any other building. Section 12-431 E separately allows cooperative off street parking when the planning director is satisfied that the uses generate traffic at nonoverlapping times of day, with shared parking and mutual easements recorded and a copy provided to the planning department. The code prints a width and a no-projection rule for loading spaces and does not set loading hours.

Violations & Fines

A site without a compliant loading space, or one whose loading space projects into a public right of way or setback area, violates Title 12. Under section 12-132 a violation is a misdemeanor punishable by up to six months in county jail, a fine not exceeding $1,000, or both, and each day is a separate offense. The Planning Director enforces under section 12-130, and the county can recover investigation, abatement and prosecution costs.
