These county ordinances apply to unincorporated areas of Bonner County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

It shall be unlawful for any person to park, or leave parked, a vehicle upon any county street, road or highway within Bonner County in such manner as to impede the free flow of vehicle traffic or where official signs prohibit parking. B. Except when necessary to avoid conflict with other traffic in compliance with applicable traffic laws, the directions of a peace officer, or any traffic control device, no person shall stop, stand or park a motor vehicle, whether occupied or not, at any place where a posted parking regulation or official sign prohibits parking. ... D. Notwithstanding the prohibitions contained in subsections B and C of this section, a person may temporarily stop, stand or park a motor vehicle for the purpose of loading or unloading merchandise or passengers while actually engaged in such activity. ... Full Breakdown

Bonner County Revised Code § 2-401 is the county's on-street parking rule. Subsection A reaches any county street, road or highway within Bonner County and bars parking, or leaving a vehicle parked, in a way that impedes the free flow of vehicle traffic or where official signs prohibit parking. Two triggers are written in: actual obstruction of traffic, or a posted prohibition.

Subsection B repeats the sign rule for stopping, standing and parking: no person can stop, stand or park a motor vehicle, occupied or not, where a posted parking regulation or official sign prohibits it. The only carve-outs are conflict with other traffic in compliance with traffic laws, the directions of a peace officer, and a traffic control device. Subsection C carries the same posted-regulation rule onto property owned by the county or under the regulatory control of the county or any highway district located in the county. Subsection E makes it unlawful to tear down, deface or alter a traffic control device containing a posted parking regulation without previous authorization from an appropriate local authority.

Subsection D is the loading exception: a person can temporarily stop, stand or park to load or unload merchandise or passengers while actually engaged in that activity. The exception is written against subsections B and C, the posted-sign prohibitions.

Subsection F covers sign placement in tight areas. The sheriff and/or a city or fire district chief, with the concurrence of the Bonner County road and bridge director or the independent highway district with maintenance jurisdiction, can request official No Parking signs on county roads with limited or restricted access, to protect public safety vehicle access. The requesting agency furnishes the signs, and the road and bridge department or the highway district installs them. If the agency and the road and bridge director cannot agree on placement, the Board of County Commissioners decides.

Section 2-480 handles who answers for a parked vehicle. Proof that the vehicle was parked in violation, plus proof that the defendant was its registered owner at the time, is prima facie evidence that the owner parked it. The owner can rebut with evidence such as a written lease or rental agreement naming the person who had the vehicle. Streets inside Sandpoint, Ponderay, Priest River and the other incorporated cities are outside this county code.

Violations & Fines

Section 2-490 makes anyone found in violation of section 2-401 guilty of an infraction subject to a fixed penalty of one hundred dollars ($100.00). Under section 2-430, a peace officer who finds a vehicle parked in violation of section 2-401 can have it removed and towed by a county road crew or commercial towing service, and the owner pays towing and storage charges to recover it. Defacing a posted parking sign falls under subsection E.

Frequently Asked Questions

What is the fine for parking where a sign prohibits it on a Bonner County road?
Section 2-490 of the Bonner County Revised Code says anyone found in violation of section 2-401 is guilty of an infraction and subject to a fixed penalty of one hundred dollars ($100.00). A peace officer can also have the vehicle towed under section 2-430, and the owner then pays towing and storage charges to get it back.
Can I stop briefly to load or unload on a county road?
Yes, within the limit written in subsection D. A person can temporarily stop, stand or park to load or unload merchandise or passengers while actually engaged in that activity, even where a posted regulation would otherwise bar it. The text covers the posted-sign rules in subsections B and C, so the loading time has to be actual loading.
Who decides where No Parking signs go on county roads?
Under subsection F, the sheriff and/or a city or fire district chief can request the signs, with the concurrence of the Bonner County road and bridge director or the independent highway district for that road. The requesting agency furnishes the signs. If the agency and the director disagree on placement, the Board of County Commissioners decides.
If someone else parked my car, am I still cited?
Section 2-480 treats the registered owner as the person who parked the vehicle once the violation and the registration are proved, but the owner can rebut it. A written lease or rental agreement naming the person who had the vehicle is one example. With several registered owners, the first named person on the registration is the one prosecuted.
