Between the hours of 10:00 p.m. and 7:00 a.m. every day, it shall be unlawful for any person to park an omnibus, school bus, school vehicle Type I, school vehicle Type II, pole trailer, road tractor, trailer, farm trailer, semitrailer, truck tractor, tow truck, motor vehicles in excess of four tons registered gross weight or in excess of 25 feet in overall length, flatbeds of any size, or any combination thereof on any street, highway, or public place in the City of Clifton; provided, however, that nothing herein shall prohibit the parking of a vehicle for the purpose of installing, maintaining or performing public utility services.

Full Breakdown

every day, to park an omnibus, school bus, school vehicle Type I or Type II, pole trailer, road tractor, trailer, farm trailer, semitrailer, truck tractor, tow truck, any motor vehicle exceeding four tons registered gross weight or exceeding 25 feet in overall length, or any flatbed of any size, on any street, highway, or public place in the City. The chapter carves out several exceptions: vehicles parked to install, maintain, or perform public utility services; vehicles carrying merchandise, goods, tools, or supplies to or from area residents or businesses; vehicles performing services for a premises owner or tenant; and recreational vehicles displaying handicapped plates or permits.

The restriction is enforced citywide and is separate from the street-by-street daytime alternate-side cleaning schedule found earlier in the same chapter, which lists specific hours and days for individual streets. Because the overnight ban targets oversized and commercial vehicles rather than ordinary passenger cars, a resident's sedan or SUV parked on a public street overnight is not, by itself, a violation of § 439-15 unless another posted restriction applies.

Violations & Fines

Any vehicle parked in violation of § 439-15 is subject to the general penalty in § 439-4: a fine of not less than $50 nor more than $1,000, imprisonment in the county jail up to 90 days, or community service up to 90 days. The Police Department may also tow and impound an illegally parked vehicle under § 439-3, with the owner billed under the City's Towing Ordinance and notified within five days of impoundment.

Frequently Asked Questions

Can I park my box truck on a Clifton street overnight?
No. Section 439-15 prohibits parking a truck tractor, flatbed, or any motor vehicle over four tons or 25 feet on any City street between 10:00 p.m. and 7:00 a.m., with narrow exceptions for utility work and deliveries to area residents or businesses.
Does the overnight ban apply to my personal car?
No. The ordinance lists specific vehicle types, buses, trailers, tow trucks, and oversized or heavy trucks, so an ordinary passenger car or pickup is not covered unless a separate posted restriction applies to that block.
What happens if my commercial vehicle is parked overnight in violation?
Police can ticket the vehicle under § 439-4, carrying a fine between $50 and $1,000 plus possible jail or community service up to 90 days, and can tow and impound the vehicle under § 439-3 at the owner's expense.
