Commerce City, CO Property Maintenance: Property Blight (2026)

Section 6-2010(a)(8) of the Commerce City Revised Municipal Code declares as a public health nuisance any structure, vehicle or property maintained or operated in a manner that endangers the health, safety, property or welfare of city inhabitants, and Section 6-2010(b) makes it unlawful for an owner or occupant to create or permit that condition to continue. The city's Property Maintenance Code, the 2021 International Property Maintenance Code as locally amended in Section 5-4401, ties directly back to that nuisance declaration: amended Section A101.1 requires that windows and doors of a structure found to be a public nuisance under Section 6-2010 be boarded in an approved manner to prevent entry by unauthorized persons and painted to match the color of the existing building, so a blighted structure cannot simply sit open and exposed.

Property Maintenance Code violations are enforced through the penalties and procedures of Article V, Chapter 5, and separately, the underlying nuisance is a civil infraction under Section 6-1003 of Chapter 6, proven by a preponderance of the evidence before the Commerce City Municipal Court or the city's administrative hearing process. The city may abate a dangerous or blighted structure without prior notice or a hearing under Section 6-1004 when it poses an imminent danger, and recover its costs from the responsible party plus a fifteen percent administrative fee under Section 3-2103.
