Jackson, TN Public Conduct: Aggressive Panhandling (2026)

Jackson Municipal Code § 11-504, most recently amended by Ordinance #2024-23 in June 2024, splits panhandling and begging into "passive" and "aggressive" categories. Passive panhandling, meaning a written request or a spoken request that does not rise to intimidation, is treated as speech protected under the First Amendment and is permitted throughout the City of Jackson, Tennessee, except where the ordinance specifically restricts it. Aggressive panhandling is banned everywhere in the city: § 11-504(3) states that no person shall engage in aggressive panhandling at any time, anywhere in the jurisdiction.

The ordinance defines aggressive conduct in detail, including confronting someone in a way that would cause a reasonable person to fear bodily harm, touching someone without consent, using obscene or abusive language, continuing to solicit after a negative response, or blocking a person's path. Even passive panhandling is further restricted in defined "heightened" zones: within twenty feet (20') of an ATM, bus stop, building entrance or sidewalk cafe, within a public parking garage or lot between dusk and dawn, on streets, highways and traffic medians under eight square feet, and on high-speed corridors including Interstate 40 ramps and any city street posted at thirty-five (35) mph or faster.

Enforcement runs through a municipal citation under T.C.A. §§ 40-7-118 or 7-63-101, decided by the city court judge, who can also refer a cited person to a social-services agency. For repeat or continuing violations rising to a public nuisance, the city attorney may seek injunctive relief in a Tennessee court of competent jurisdiction.
