Vestavia Hills, AL Public Conduct: Aggressive Panhandling (2026)

Section 8-262, part of Article IX added by Ordinance No. 2418 on October 8, 2012, makes it unlawful for any person to engage in panhandling anywhere in the city. The article defines panhandling broadly: any solicitation made in person on a street, sidewalk, public way, or public place, or on the premises of a business or other private property that is routinely or customarily open to the general public, that requests an immediate donation of money or anything else of value for the panhandler or for another person or entity.

The prohibition is not limited to aggressive conduct, a specific time of day, or a distance from an ATM or bus stop; a single in-person request for an immediate handout anywhere the public gathers falls under the ban. The section sits alongside the article's separate rules for door-to-door soliciting and peddling, defined earlier in Section 8-251, but panhandling is treated as its own, flatly prohibited category rather than something that can be registered or permitted like residential solicitation. Section 8-263 sets the enforcement path: anyone cited for panhandling must appear in Vestavia Hills Municipal Court, where a conviction carries whatever fines and court costs the court assesses, without a separate dollar cap written into the article itself.
