Albany, OR Public Conduct: Jaywalking (2026)

Chapter 13.28 of the Albany Municipal Code, titled Pedestrians, holds three short rules that together make up the city's jaywalking law for the City of Albany, Oregon.

Section 13.28.010 keeps walkers off the road: pedestrians shall not use any roadway for travel when sidewalks abutting the same are available.

Section 13.28.020 covers crossings between corners. No pedestrian shall cross a street at any place other than by a route at right angles to the curb or by the shortest route to the opposite curb, except in a marked crosswalk. The test is geometric: the route must be at right angles to the curb or the shortest route to the opposite curb.

Section 13.28.030 is stricter where crosswalks exist. No pedestrian shall cross a street other than within a crosswalk in blocks with marked crosswalks. In a block with a marked crosswalk, the crosswalk is the only lawful place to cross.

The crossing rules sit beside rules that protect crosswalk space. Section 13.21.030(2) bars drivers from stopping, standing or parking on a crosswalk, and the City Manager designates crosswalks at intersections where deemed necessary for pedestrian safety (§ 13.12.020). Drivers carry their own duty: under § 13.36.070 a driver shall not back a vehicle unless the movement can be made with reasonable safety, and shall in every case yield the right-of-way to moving traffic and pedestrians.

Enforcement runs through the Albany Police Department. Under § 13.52.020, for the violation of any provisions of Title 13, any police officer can issue a citation in the nature to appear at a time and place certain, and the case goes to the Albany Municipal Court. Chapter 13.28 has three sections and no distance rule measured from the nearest intersection.
