Albany, OR Public Conduct: Public Alcohol Use (2026)

The rule in the City of Albany, Oregon, has two prongs, both in AMC § 7.08.040. Subsection (1) bars drinking or consuming any alcoholic beverage while in or upon any street, alley, public grounds, building, or place open and available to the general public, and it also reaches a person in a motor vehicle on premises open to the public. Subsection (2) is the open container rule: it is unlawful to possess on one's person any bottle, can, or other receptacle containing alcohol that has been opened, has a broken seal, or has had part of its contents removed. Drinking is covered by subsection (1) whether or not a container is carried.

Subsection (3) exempts places where possession or consumption is subject to the control or regulation of the Oregon Liquor Control Commission, places where State law otherwise permits it, places the City of Albany authorizes, and any City park where no other provision of the code prohibits alcohol. Subsection (5) defines an alcoholic beverage as any beverage containing more than one-half percent of alcohol by volume, so the line sits at one-half percent and not at a beer or spirits threshold.

Albany Station has a companion rule in § 7.08.035. It bans consuming alcohol, and carrying an opened container, on all City-owned property holding train or multimodal facilities and the City-owned property next to it. The area is bounded by Pacific Boulevard (OR 99E) on the north and west, 12th Avenue on the south, and Union Pacific Railroad property on the east. The City Manager or designee can issue special permits there on whatever terms are deemed appropriate.

Repeat offenders face more downtown. Under § 7.84.230, three or more violations of AMC § 7.08.040, counted alone or with other listed offenses in separate incidents within a six-month period inside an enhanced law enforcement area, can make up the crime of persistent violation.
