Chapter 96, Streets and Sidewalks, devotes a short subchapter titled 'Obstructing' to blocked public ways. Section 96.35 prohibits two distinct acts: plowing, planting or cultivating within the fence lines of any town street in a way that fills up or obstructs its drains or gutters, and placing or leaving any obstruction in a street, footpath or sidewalk, except where the chapter itself permits work such as a sidewalk or curb permit under section 96.01. Section 96.36 then makes it a separate violation to knowingly or willfully break section 96.35, layering an intent-based offense onto the strict prohibition in 96.35.

Both sections trace to the 1966 Code, sections 59-25 and 59-26 respectively, showing the ban predates the current code by decades. Section 96.99(B) sets the penalty for either section at not less than $5 nor more than $50 for each offense, a range distinct from the $5-to-$25 penalty the same section reserves for violations of the sidewalk and driveway work-permit sections 96.01, 96.05 and 96.08. The rule reaches everyday obstructions, dumped material, construction debris, or plantings placed close enough to a street to block its gutters or drains, and it applies regardless of whether the obstruction was placed intentionally or through neglect of drainage.
