Hamden, CT Public Conduct: Outdoor Smoking Restrictions (2026)

Section 102.02(A) prohibits, at all times, an individual smoking or using any tobacco product in any form while at a town park or recreational property, on public school grounds, or on other specified sections of town-owned property. Section 102.01 defines 'TOBACCO PRODUCT' broadly to include lighted cigarettes, cigars, pipes, electronic cigarettes such as e-hookahs and vape pens, chew tobacco, snus and snuff, and any nicotine-containing product not FDA-approved for treating tobacco dependence. 'PARK OR RECREATIONAL PROPERTY' under Section 102.01 covers sports fields, playgrounds, bike and walking paths, dog parks, bleachers, gardens and passive recreation areas, but excludes school grounds, which are separately defined and covered.

Section 102.02(B) allows the Mayor or a designee, in consultation with the Parks and Recreation Commission, to designate limited areas where tobacco use may be permitted. Section 102.03 requires the town to post 'Tobacco Free Zone' signs identifying the chapter by number and stating the penalty amount, and Section 102.04 assigns enforcement to members of the Hamden Police Department, who must inform a violator before taking enforcement action.
