Alpharetta, GA Public Conduct: Outdoor Smoking Restrictions (2026)

Alpharetta bans tobacco use across the entirety of its park system rather than carving out smoking areas or patios. Sec. 32-5 states that it is unlawful for any person to use tobacco products within any city park, and it defines that product list broadly to include, but not limit to, cigarettes, e-cigarettes, cigars, chewing tobacco, snuff, and pipes. The definition of city park in the same section is written just as broadly: it reaches any park within the city owned or operated by the city, including all facilities, buildings, stands, concession areas, grounds, fields, playgrounds, parking lots, trails, greenspaces, and greenways, so the ban follows the park boundary rather than stopping at a building door.

Sec. 32-4(a)(2) restates the same rule inside the general park rules and regulations, confirming the tobacco ban applies alongside the section's other park conduct rules such as the leash requirement for pets and the ban on open alcohol containers. The city does not condition the ban on posted signage: Sec. 32-5 directs the director of recreation and parks to post signs describing the policy throughout city parks, but it expressly states that the failure to post any such sign does not relieve a person of the obligation to comply.

A violation of Sec. 32-5 is a misdemeanor punishable the same way as other violations of the city's park rules and regulations, which under Sec. 32-4(c)(3) means a fine under the Sec. 1-8 penalty schedule or up to 45 days of supervised labor on city public works instead.
