Edmond, OK Public Conduct: Outdoor Smoking Restrictions (2026)

Section 8.08.340(b)(4) sets the outdoor rule in one sentence: use of tobacco products and vapor products is prohibited on all Municipal Property, both indoor and outdoor. Subsection (a)(19) defines Municipal Property as all buildings, indoor areas and outdoor areas, including recreational areas, owned or operated by the City of Edmond, plus city vehicles and equipment. Subsection (a)(20) defines an outdoor area as any area that is not an indoor area. The ban therefore covers the grounds around city buildings and every recreational area the city owns or operates, not just the rooms inside.

The rule reaches beyond cigarettes. Smoking means combustion of any cigar, cigarette, pipe or similar article. Vapor products are a separate defined term: noncombustible devices, with or without nicotine, that use a heating element, battery or circuit to produce vapor, including e-cigarettes, e-cigars and e-pipes. Products the FDA has approved as tobacco cessation products fall outside the tobacco product definition, and products regulated by the FDA under Chapter V of the Food, Drug, and Cosmetic Act fall outside the vapor product definition.

On private property the section works through a buffer. Subsection (b)(10)a. bars use within fifteen (15) feet of any entrance, exit or air intake of an indoor area open to the public or an indoor workplace. Among the listed exceptions, item 10 of (b)(10)b. allows smoking in any outdoor seating area of a restaurant, but not within 15 feet of any exterior public doorway or any air intake of the restaurant. Subsection (g)(2) confirms that any person or entity can prohibit tobacco and vapor use on its own property even where the city does not.

Signs and waste follow the same section. Under (c)(4), outdoor signs must be weather-resistant, at least 15 inches by 15 inches, with lettering of at least 1 inch. The City Manager or a designee posts signs on municipal property, and under (c)(5) the absence of a sign is not a defense. Subsection (e) bars ash receptacles in any area where smoking is prohibited by law and bars disposing of tobacco or vapor product waste in a prohibited area. The current text was amended by Ord.
