Full Breakdown
Section 8.08.230 bans drinking or otherwise consuming any intoxicating beverage or liquor in a public place, in a vehicle, or in or about a public place, unless authorized under the Oklahoma Alcoholic Beverage Control Act; it separately makes being drunk or intoxicated on a public or private road, in a vehicle, building, or at a public gathering a misdemeanor. Two related rules narrow the picture further: § 8.08.300 bars leaving a bar or restaurant with an open container, and § 10.28.045 separately bans transporting an open container inside a moving vehicle unless it's sealed or stowed in the trunk.
Violations & Fines
A violation is a straight misdemeanor with no set BAC or container-type test: an officer just needs to observe drinking, possession, or visible intoxication in a public place or gathering.
