325, added by Ordinance 3126 in 2009, does not ban smoking in every Fullerton park; it targets specific higher-risk locations. Subsection (A) prohibits smoking a cigarette, cigar or other tobacco-related product on any public recreational trail, at Laguna Lake Park specifically, in any park located within a state-designated very high fire hazard severity zone, or in any other area the City Manager or a designee has marked with a posted "No Smoking" sign. Subsection (B) puts the posting duty on the Director of Parks and Recreation, who controls the wording, size, color, design and placement of those signs, so the exact footprint of the ban can expand as signage goes up.

The ordinance also protects people who try to enforce it: subsection (C) makes it separately unlawful to intimidate, threaten or retaliate against someone who seeks compliance with the smoking rule, meaning a smoker who confronts or threatens a person asking them to put it out commits its own violation. Enforcement sits with the Parks and Recreation Director, park attendants, parking control officers and police officers under the chapter's general enforcement sections.
