Newport Beach, CA Public Conduct: Outdoor Smoking Restrictions (2026)

020 makes it unlawful to smoke tobacco products in elevators of public buildings; in public areas of health care facilities and hospitals except designated smoking areas; in hearing rooms, conference rooms and other places where public business is conducted; in enclosed theaters, auditoriums or similar venues open to the public; in service lines where more than one person is being served; within 50 feet of any posted nonsmoking area; within 1,000 feet of a school or day care center; within 50 feet of an outdoor dining area; in a vehicle parked on public property if the smoke is detectable outside it; in or within 100 feet of any public park, park facility, beach, or the oceanfront boardwalk while on public property (except a person driving through in a car or truck); and within 50 feet of a farmers' market or permitted special event.

The chapter separately bans smoking any flavored tobacco product anywhere on public property, including parks, sidewalks, public buildings and schools (Sec. 020(L)). Disposing of a cigarette, cigar, or other smoking material anywhere smoking is prohibited, other than in a designated receptacle, is a separate violation that does not preclude prosecution under state littering laws such as Health and Safety Code Sec. 13002 or Penal Code Sec. 4 (Sec. 025). Anyone with control of a room, building or area where smoking is banned must post conspicuous all-capital signage at least one inch high on a contrasting background (Sec. 040).
