Summary

Garland extends its smoking ban outdoors in three spots: within 50 feet of any playground or recreation area inside a city park, along the perimeter sidewalk ringing the downtown city square, and inside any area the City Manager posts with a designated no-smoking sign. The rule sits in the same Article IV ordinance that bans smoking indoors citywide.

Smoking is prohibited in the following public places: (1) On public property located within 50 feet of playground areas, or other areas primarily designed for recreational activities, within a city park; (2) On public property located within the interior edge of the perimeter sidewalk around the downtown city square; (3) On public property, or portion thereof, designated by the City Manager as a "no-smoking" area, where such area is demarcated by sign(s) that are consistent with the requirements of subsection (B).

Full Breakdown

56(C) of the Code of Ordinances lists three outdoor places where smoking is prohibited even though they are open-air: within 50 feet of playground areas or other recreational areas inside a city park, along the interior edge of the perimeter sidewalk around the downtown city square, and any public property the City Manager designates as a no-smoking area once it carries a conforming sign. That sign requirement comes from subsection (B): a posted "No Smoking, City of Garland Ordinance" notice or the international no-smoking symbol, in bold lettering at least one inch tall, at each public entrance.

55 covers e-cigarettes and vaping devices as well as burning tobacco, so the outdoor bans apply to vapers too. 56(D)(7) shows the outdoor line the City actually draws: uncovered outdoor areas on public golf courses are exempt as long as they sit at least 25 feet from any door, window, or entrance of a clubhouse or pavilion. Chapter 22 is captioned "Health," and the smoking article was adopted by Ordinance 5969 (2/21/06) and last amended by Ordinance 6977 (4/3/18), which added the vaping and private-club provisions.

Violations & Fines

Smoking article violations are prosecuted under the Code's general penalty, Section 10.05, which fines public-health and sanitation violations up to $2,000 per offense (other Code violations cap at $500), and treats each day the violation continues as a separate offense. There is no dedicated smoking-article penalty section; Section 10.05 applies by default because Chapter 22 is the Health chapter.

Frequently Asked Questions

Can I smoke in a Garland city park?
Not within 50 feet of a playground or other area designed for recreational activity. Section 22.56(C)(1) prohibits smoking on public property inside that buffer at any city park, though the rest of an open park lawn away from play areas is not covered by this specific ban.
Is vaping treated the same as smoking cigarettes outdoors in Garland?
Yes. Section 22.55 defines "smoking or smoke" to include inhaling or exhaling from an electronic vaping device, so the outdoor bans in Section 22.56(C), including the park and downtown-square restrictions, apply equally to e-cigarettes.
Are there any outdoor exemptions to Garland's smoking rules?
Yes. Section 22.56(D)(7) exempts uncovered outdoor areas on public golf courses, as long as they are at least 25 feet from any window, door, entrance, or exit of a patio, pavilion, or building designed for human occupancy.
