Kyle, TX Public Conduct: Outdoor Smoking Restrictions (2026)

Section 26-91 sets a standalone list of rules specifically for Lake Kyle Park, and item (4) states flatly that no smoking is permitted in Lake Kyle Park, alongside neighboring bans on outside pets other than service animals, alcohol, and swimming in the lake itself. The park is open only during hours the parks director posts and is closed once the main access gate off Lehman Road shuts; Section 26-91(2) makes a person's presence in the park while closed a criminal trespass unless the person holds a permit to be there.

Separately, Section 26-90(16) bans smoking or tobacco use of any type inside the city pool complex, one of a list of pool rules that also forbids alcohol, glass containers, and outside food or drink there. Neither Section 26-84, which lists prohibited activities for city parks generally, such as unleashed pets, camping without a permit, unauthorized fires, hunting, littering, and glass containers, nor the general park-use article otherwise mentions smoking, so Kyle's smoking restriction is tied to these two named facilities rather than every outdoor public space.

Because Section 26-91 and Section 26-90 set no fine of their own, an unpermitted violation falls under the Code's general penalty, Section 1-14, up to $500.00 per offense, and Section 26-89 lets a park attendant or police officer issue a warning or citation, or require the person to leave under Section 26-88.
