Lenexa, KS Public Conduct: Outdoor Smoking Restrictions (2026)

Section 3-5-F-3-G of the Lenexa City Code lists three sets of outdoor public places where smoking is prohibited. First, all City-owned public outdoor courts, amphitheaters, park shelters and playground areas, and the area within fifteen feet of their perimeter. Second, all City-owned public outdoor swimming pool facilities, and the area within fifteen feet of the fence surrounding them. Third, all City-owned public bleachers and grandstands used by spectators at sporting and other public events, and the area within fifteen feet of them. The list reaches only City-owned facilities. It does not extend to private patios or privately owned outdoor areas, although Section 3-5-F-3-F-19 separately makes the access points of covered buildings smoke-free, and Section 3-5-I-6 defines an access point as the area within a ten foot radius outside a doorway, open window or air intake.

Section 3-5-I-6 defines smoking or smoke to include the use of a vapor product, so e-cigarettes, vapor pens and hookahs count alongside lighted cigarettes, cigars and pipes. The City Council adopted the Article under the Kansas Indoor Clean Air Act, which lets it regulate smoking so long as its rules are at least as stringent as the state law. Section 3-5-F-4 leaves private residences, tobacco shops, vapor retailers and hookah bars outside the Article. Section 3-5-F-5 requires the proprietor or person in charge of a place where smoking is prohibited to post signs with the international no smoking symbol stating that smoking is prohibited by law, and makes it unlawful to allow smoking where prohibited when the person knows it is occurring and acquiesces. Separately, Section 3-5-F-7 makes it unlawful for anyone under 21 to buy or possess cigarettes, vapor products or tobacco products, with a fine of no more than $25.
