Parsippany-Troy Hills, NJ Public Conduct: Outdoor Smoking Restrictions (2026)

Section 290-18 A of the Parsippany-Troy Hills Township Code prohibits smoking in all Township parks, expressly including athletic fields, sports courts and play areas, and names the Parsippany Police Athletic League Youth Center at 33 Baldwin Road. The text excepts municipal golf courses. Smoking is permitted only in adjacent parking areas located outside of a public park or athletic field, and the section ties that rule to the New Jersey Smoke-Free Air Act, N.J.S.A. 26:3D-56 et seq. The ordinance was added 5-20-2014 by Ord. No. 2014:06 and amended 8-20-2019 by Ord. No. 2019:38.

The definition of smoking in § 290-7 is broad. It covers the burning of, inhaling from, or exhaling the smoke from, or the possession of, a lighted cigar, cigarette, pipe, or any other matter or substance which contains tobacco or any other matter that can be smoked. It also covers inhaling or exhaling smoke or vapor from an electronic smoking device, so vaping in a Township park falls under the same ban as a cigarette.

Enforcement is by the Police Department of the Township of Parsippany-Troy Hills. Under § 290-18 B any person can initiate enforcement by registering a complaint with the Police Department, so a park user does not need to be an official to trigger a response.

Other Chapter 290 rules touch tobacco in parks. Section 290-9 C bars throwing away or discarding any lighted match, cigar, cigarette, tobacco, paper or other material other than in a container provided by the Department, and it restricts fires, including cooking fires, to places provided for that purpose under the continuous care of an adult. Section 290-14 makes all applicable Township ordinances, state laws and Department rules part of the park article.
