Town Code § 90-2 prohibits smoking or vaping any tobacco, marijuana or herbal product, carrying lit cigarettes, cigars or cigarillos, or using pipes, e-cigarettes, or discharging vape pens, vapors or e-liquids within a "designated nonsmoking area" as defined at § 90-1. That definition, most recently amended November 26, 2024 by Local Law No. 25-2024, reaches within 500 feet of any posted "No Smoking" sign on Town property; within 500 feet of any lifeguard stand or roped protection area during lifeguard hours at Town beaches; boardwalks and common walkways leading to Town beaches; within 500 feet of any playground, athletic field or sports court, including bleachers; within 500 feet of beach pavilions at Ponquogue, Tiana and Sagg Main Beaches; within 500 feet of beach comfort stations at Pike's, Flying Point, Mecox, Scott Cameron, Foster Memorial and William Swann beaches; inside named parks including Tiana Bayside, North Sea Community Park, Good Ground Park, Red Creek Park, East Quogue Village Green, Hampton West, Ludlam Avenue, Iron Point and Wildwood Lake Parks and Shinnecock Canal Maritime Park; and within 30 feet of public transportation vestibules and shelters. Single- and two-family residences used by their occupants and guests are excluded from the definition.
Violations & Fines
Section 90-3 sets a penalty of up to $250, with a judge able to substitute up to 24 hours of community service in lieu of a fine; the offense is classified as a violation-level offense. Every conviction also carries a mandatory $100 blight mitigation surcharge paid to the court clerk, and each day a violation continues is a separate offense.
