Huntington, NY Public Conduct: Outdoor Smoking Restrictions (2026)

Section 159-20(N) of the Recreational Facilities chapter forbids smoking or vaping a tobacco product, herbal product, cigarette, electronic cigarette, pipe, cigar, vapor or e-liquid in an outdoor playground, athletic field or beach operated by the Town of Huntington. The Town wrote the ban narrowly: it applies only to public playgrounds and beaches and is not intended to reach private property the general public cannot access, or private areas used exclusively for private functions, so a backyard party or a members-only club event falls outside its scope.

The Town must post "No Smoking" signs, or the international no-smoking symbol, prominently wherever the section is enforced, and if a playground is not enclosed by fencing or another partition, the smoking ban extends only as far as the posted signs reach rather than to the whole open area. Beach parking lots are expressly carved out of the ban, so a driver may still smoke in a beach parking lot even though smoking on the sand or boardwalk is prohibited. The same subsection sits inside the park's broader Behavior and Conduct rule, § 159-20, which in the paragraph directly above also bars consuming cannabis in a park or beach, including parking lots, and directly below restricts skateboards and scooters to designated areas, giving code enforcement a single section to cite for a range of outdoor conduct violations.
