Huntington, NY Public Conduct: Public Urination (2026)

Section 135-6, titled simply 'Public Conduct' and added in 2021 by Local Law No. 54-2021, reads in full: no person shall defecate or urinate in any public place except in a public or private toilet or restroom, borrowing the definition of 'public place' from New York State Penal Law Article 240, the statute covering offenses against public order. Because the Town incorporates the state Penal Law definition rather than writing its own, enforcement officers apply the same 'public place' test used in criminal disorderly-conduct cases statewide: a place to which the public or a substantial group has access, including streets, parks, business lobbies, public buildings and similar areas.

The prohibition is chapter-wide alongside the Town's other public-conduct rules in Chapter 135, which also cover loitering, congregating, solicitation on public and private property, and cannabis consumption on Town property. Penalties escalate on repeat violations within a five-year lookback window, and the Bureau of Administrative Adjudication can pursue the same monetary range civilly when a criminal summons isn't issued. The Town Attorney additionally may seek injunctive relief and civil penalties up to $250 per day under § 135-16(G) for ongoing violations of the chapter.
