Stonecrest, GA Public Conduct: Outdoor Smoking Restrictions (2026)

Article VIII, the City of Stonecrest Smoke-Free Air Ordinance adopted by Ord. No. 2018-06-04, defines "outdoor recreational public place" broadly in Sec. 18-73 to include "parks, picnic areas, playgrounds, athletic or sports fields, golf courses, walking paths, gardens, hiking trails, bike paths, horseback riding trails, swimming pool facilities," and more, language written for a city that includes Arabia Mountain's PATH trail and its municipal parks. Sec. 18-74's general prohibition reaches those places directly, alongside "public places," "common areas," and "places of employment," and Sec. 18-75 separately singles out any vehicle "owned, leased or operated by the city." Sec.

18-76(a) then layers a spatial buffer on top of the place-based ban: smoking is barred within 20 feet of any outside entrance, window, or ventilation system of those covered places, and within 20 feet of any indoor service line, though the buffer specifically exempts "porches, courtyards or decks contiguous to a restaurant." Parking lots get a narrower rule under Sec. 18-76(b): smoking is generally allowed there unless it falls within the 20-foot buffer or the property owner has posted "No Smoking" signs. Sec. 18-77 carves out limited exemptions, private residences, up to 25 percent of hotel and motel rooms, retail tobacco stores, and restaurant or bar private rooms with independent ventilation, none of which cover a public park or trail.

Signage and enforcement responsibilities fall to the owner or operator under Secs. 18-80 and 18-81, who must post "No Smoking" signage and ask violators to comply.
