Tamarac, FL Public Conduct: Outdoor Smoking Restrictions (2026)

Adopted by Ordinance No. O-2023-001 on January 11, 2023, § 15-90 of the Code of Ordinances prohibits smoking, holding a lighted tobacco product, or using or consuming tobacco products, including e-cigarettes and vapes, in any park under the control and management of the City of Tamarac. The section separately spells out the conduct it bans: carrying a lighted cigar, cigarette, cigarillo or pipe, or using a spark, flame, match or other fire-producing device normally used for tobacco smoking, or using or consuming tobacco products or e-cigarettes anywhere in a city park.

The single exception written into the section allows smoking unfiltered cigars. Because § 15-90 sits in Article III of chapter 15 (rules and regulations), it is enforced the same way as the rest of that article's park rules: § 15-91 lets Broward Sheriff's Office deputies working under the city's police contract, city code enforcement officers, or other city-designated employees cite violators, and it directs that anyone violating this article be ordered to stop immediately. Fines run from $250 for a first-day violation to $500 per day for each additional occurrence, with the code enforcement board or special magistrate empowered to impose civil penalties up to $1,000 for a first violation, $5,000 for a repeat violation, and $15,000 if the violation is irreparable or irreversible, plus the city's enforcement costs. The city can also pursue an injunction or a civil damages action instead of, or alongside, those penalties.
