Upland, CA Public Conduct: Outdoor Smoking Restrictions (2026)

Section 9.60.010, adopted by Ordinance 1942 in 2020, states plainly: "Smoking, including, but not limited to, the use of any electronic smoking device, is prohibited in all public spaces in the city." Section 9.60.020 defines "public spaces" as "any property or building owned or operated by the city, inclusive of city-owned or operated building or unenclosed area held open by the city for public use such as public parks and recreation areas, public plazas, and the Euclid Avenue median," but carves out "any city-owned property or building the city has leased for private use." "Smoking" is defined broadly to include possessing or operating a lighted pipe, cigar, or cigarette; lighting, igniting, or vaping an electronic smoking device; and inhaling, exhaling, burning, vaping or vaporizing any lighted, heated or ignited tobacco product "in any manner or in any form." An "electronic smoking device" covers e-cigarettes, vape pens, electronic cigars, cigarillos, hookahs and vaporizers, but excludes FDA-approved cessation inhalers.

Chapter 9.60 carries no chapter-specific penalty section, so enforcement of a violation observed in a city park, plaza, or along the Euclid Avenue median defaults to the citywide code enforcement and misdemeanor structure in Chapter 1.16, and code enforcement officers, not just police, are authorized to issue citations for violations within city-owned parks and facilities.
