Except as provided herein, it shall be unlawful for any person to drink any vinous, malt or other alcoholic beverage while on any streets, sidewalks, alleyways, parking areas or other open areas operated and controlled by the city, or while in or on the grounds of any MARTA station.

Section 10-8 of the Atlanta Code makes it unlawful to drink any vinous, malt or other alcoholic beverage on city streets, sidewalks, alleyways, parking areas, other city-controlled open areas, or on MARTA station grounds. The same ban covers city parks, except during permitted outdoor festivals or at licensed park locations. Sidewalk cafes may serve alcohol in outdoor dining areas, and only working employees can carry open containers to or from those areas. From March 16, 2026 through January 31, 2027, the ban is suspended inside the South Downtown Open Container District, a mapped zone bounded by Broad, MLK Jr. Drive, Forsyth, Mitchell, Ted Turner Drive, Nelson, Trinity and Peachtree Streets.
