City Code § 10-71 makes it an offense to consume an alcoholic beverage, or to possess an open container that contains an alcoholic beverage, in any park or vehicle parking area or interior roadway within a park. The section defines 'alcoholic beverage' by reference to the Texas Alcoholic Beverage Code. The only built-in defense to prosecution is that the person was on a site the city council specifically designated, by council action, as a place where alcohol consumption or open-container possession is allowed; absent that council designation, the general ban applies citywide across all park property.

The prohibition sits within Article III of Chapter 10 alongside § 10-72, which separately bans bringing, carrying, transporting, or possessing glass containers customarily used to transport liquids in any park area, with an exception allowing glass to the extent a city permit for an event at Wayne Ferguson Plaza allows it. Both alcohol-related park rules are enforced the same way as the rest of Chapter 10: the director, designated park enforcement officers, and certified peace officers may issue citations under § 10-27(c), and violations are Chapter 10 misdemeanors.
