Milton, WI Public Conduct: Public Alcohol Use (2026)

Section 50-115, most recently amended by Ordinance No. 498 in 2022, bars drinking or carrying an alcoholic or fermented malt beverage for immediate consumption on the streets, sidewalks, parks, public parking lots, public school property or other public property of the City of Milton, and on any private parking lot open to public use. The ban expressly excludes Milton Township Hall and the Milton-Milton Township Fire Hall from its reach as public property, since those are jointly used facilities. The section carves out a permit-based exception: people may drink or carry fermented malt beverages and wine at the Community House, Lamar Park, Veterans Park and South Goodrich Park once they obtain a permit from the city clerk.

The permit application must be filed concurrently with a rental of the Community House or the Lamar Park pavilion, and consumption is confined to the enclosed structure or paved pavilion area covered by that permit. A separate park special event permit, filed with a council-set fee, can extend the permitted consumption area to adjacent park space, but that expanded area can never include any part of an athletic field or playground. The section was renamed by Ordinance No. 380 in 2013 from covering 'public and private areas' to the narrower title reflecting the current public-property focus.
