Ogden, UT Public Conduct: Public Alcohol Use (2026)

' The section defines that term to cover any public street, sidewalk, alley or right of way; any public park; any publicly owned building or real property; outdoor areas on commercial or manufacturing premises without the owner's permission; boarded, vacant or abandoned commercial buildings; and vacant lots zoned for commercial or manufacturing use. Separately, subsection B bars consuming liquor specifically in a public building, park or stadium unless a special event permit has been issued under Utah Code Annotated section 32A-7-101. The code carves out four narrow exceptions: a concessionaire holding a city-granted alcohol license in a park or recreational facility, during a city-approved special event beer license for a civic event, under a permit for the MTC Learning Park, Dinosaur Park, the Ogden Amphitheater or Union Station, and within premises covered by a city title 5, chapter 3, article C alcoholic beverage license.

Anyone other than the licensed concessionaire who brings alcohol into a concession-permitted park, or who drinks alcohol the concessionaire did not sell, is separately in violation. Ogden police enforce the section, and an offense is a class C misdemeanor under title 1, chapter 4 of the code. The section also separately criminalizes public intoxication to a degree that endangers the person or others, giving officers discretion to release an intoxicated person to a detoxification center instead of jail.
