The ban does not require proof of public intoxication, only possession of an open container in a covered location, so a sealed can carried through a park draws no citation while an opened one does.
Violations & Fines
A first violation of Chapter 9.34 is an infraction under Section 9.34.040. A fourth or later violation within a twelve-month period becomes a misdemeanor. Each day, or portion of a day, that a violation continues counts as a separate offense, so repeated open-container conduct on the same outing can stack citations.
