Rohnert Park, CA Public Conduct: Public Marijuana Use (2026)

Rohnert Park does not have a standalone public marijuana consumption ordinance; instead, Chapter 8.32, Smoking and Secondhand Smoke, folds cannabis into its citywide smoking ban by definition. Section 8.32.030(T) defines smoking to mean inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, or pipe, or any other lighted or heated tobacco, cannabis, or any other weed or plant product intended for inhalation, and separately reaches vaporized cannabis by including any electronic smoking device that creates an aerosol or vapor. Because that definition governs the whole chapter, every place where smoking is banned is also a place where smoking cannabis is banned.

Section 8.32.050(A) prohibits smoking, cannabis included, in enclosed places of employment and public places, whether publically or privately operated, among other enclosed spaces such as multi-unit common areas and city-owned buildings. The prohibition is not limited to indoor spaces: § 8.32.050(B) extends the same ban to specified unenclosed areas, including recreational areas and any public place being used for an event like a farmers' market or fair. Section 8.32.050(C) further bars smoking within twenty-five feet of any doorway, window or vent into a place where smoking is prohibited. Enforcement runs through § 8.32.090, which makes any violation of the chapter an infraction, and separately lets a private citizen sue to abate the conduct as a public nuisance under § 8.32.040, since a city smoking citation applies independent of state or federal marijuana law.
