Salinas, CA Public Conduct: Public Alcohol Use (2026)

Chapter 21, Article I of the Salinas Municipal Code addresses public drinking in two adjoining sections. Sec. 21-2 prohibits drinking beer, wine, or any other intoxicating beverage on any public street, sidewalk, alley, highway, plaza, parkway, parking lot, airport terminal, or bus or train depot within the city; the only carve-out is for a sidewalk cafe operating under an encroachment permit issued under Article V of Chapter 30. The section applies regardless of age, drinking itself in a covered public place is the violation, and the code notes it is not meant to duplicate any separate state-law offense for the same conduct.

Sec. 1 goes further for city parks and recreation facilities: possessing any alcoholic beverage above one-half of one percent alcohol by volume anywhere in a city park or recreational facility is unlawful, not just drinking it. The section carves out only two situations: events at the Salinas Rodeo Grounds, Salinas Municipal Stadium, Sherwood Hall, and Sherwood Park with approval from the library and community services director, and use of a recreational building or facility whose operating permit or policies allow alcohol.
