Blue Springs, MO Public Conduct: Public Marijuana Use (2026)

In the City of Blue Springs, Missouri, Section 225.190(C) of the City Code, adopted by Ordinance No. 5183 on January 17, 2023 following the Missouri Constitution's Article XIV recreational marijuana amendment, makes it unlawful to smoke marijuana in a public place unless the location is licensed for on-site consumption. A violation is a civil offense carrying a penalty of up to $100, enforced by the Blue Springs Police Department. The public-smoking ban sits alongside the same Section's possession rules: adults may not possess or give away more than three ounces of dried, unprocessed marijuana, and exceeding that limit escalates from a $250 civil penalty on a first offense to $500 on a second and a misdemeanor charge with a fine up to $1,000 and forfeiture of the marijuana on a third.

Anyone under twenty-one caught possessing, using or transporting marijuana faces a separate $100 civil penalty under Subsection D, with an option to attend up to four hours of drug education instead of paying. Home cultivation is capped at six flowering plants, six non-flowering plants and six clones per registered patient in a locked space not visible from a public place; a cultivation area visible from the street draws its own $250 penalty. Separately, Section 225.140 bars administering medical marijuana in public, a distinct provision governing the City's medical marijuana program rather than recreational use.
