Lake Havasu City, AZ Public Conduct: Public Marijuana Use (2026)

Development Code § 14.03.03C.17.a.iii, the operation standards for medical marijuana businesses, opens with an outright prohibition: on-site consumption of marijuana is prohibited at the dispensary or infusion facility itself. The same subsection separately requires the dispensary to post a notice, clearly, conspicuously and legibly, stating that ingesting or consuming marijuana in any public area within the city is prohibited and that ingesting or consuming marijuana on the premises is also prohibited, making the public-area ban citywide rather than limited to the dispensary's own property. The parallel operation standard at § 14.03.03C.17.b.iii imposes the identical on-site consumption ban and public-area notice requirement on marijuana establishments and marijuana testing facilities licensed under the Smart and Safe Arizona Act.

Both subsections also cap business hours at 7:00 a.m. to 10:00 p.m., meaning no sales or on-premises activity, let alone consumption, can occur outside that window. Read together, the ordinance draws a clear line: nowhere in the city, whether on dispensary property or any other public area, may a person legally consume marijuana, and licensees are made responsible for posting that rule where customers will see it.
