Woodbury, MN Public Conduct: Public Marijuana Use (2026)

Section 13-12, adopted by Ordinance No. 2038 on August 9, 2023, bans smoking cannabis flower, cannabis products, lower-potency hemp edibles or hemp-derived consumer products in public places "as broadly as allowable" under the state's cannabis preemption statute, Minn. 0263, subd. 5. The ordinance defines "public place" expansively: it is every place in the city except a private residence and its curtilage or yard, private property not generally open to the public (unless the owner has explicitly barred cannabis use there), and the premises of an establishment or event licensed for on-site cannabis consumption.

"Smoking" is defined by cross-reference to the Minnesota Clean Indoor Air Act, Minn. 413, subd. 4, and the ordinance specifies the ban applies whether the smoking happens indoors or outdoors. The prohibited act itself is stated simply in subsection (d): no person may smoke cannabis flower, cannabis products, lower-potency hemp edibles or hemp-derived consumer products in a public place within the city. Because the definition of "public place" excludes most private property by default, the practical reach of the ban falls on streets, sidewalks, parks, parking lots, and other city-owned or publicly accessible land, plus any private business that has not authorized on-site consumption. A violation is a petty misdemeanor under subsection (e), the lowest tier of city offense, rather than a full misdemeanor.
