Davis, CA Public Conduct: Public Urination (2026)

01 (In General) of the Offenses-Miscellaneous chapter, flatly bars urinating or defecating in public unless the person is using a toilet, urinal or commode inside a restroom, bathroom or other structure enclosed from public view. There is no carve-out for emergency need, a closed business, or the absence of a nearby public restroom: the ordinance is written as an unqualified prohibition, subject only to the two named enforcement exceptions. Subsection (b) exempts children five years of age or younger, and any person of any age whose conduct results from a verified medical condition affecting bladder or bowel control; both exceptions require the underlying fact (age or a medical condition) to be established, not merely asserted, before they apply.

Anyone who violates the section without qualifying for either exception is guilty of an infraction under subsection (c). 020. Ordinance 2634 in 2022 renumbered several of the article's public-order sections but left the underlying urination and defecation ban unchanged.
