Fontana, CA Public Conduct: Public Urination (2026)

Fontana Municipal Code Sec. 16-163 states plainly that it is unlawful for any person to urinate, defecate, or dump fecal matter on public or private property in an area exposed to public view, or on any public right-of-way, street, sidewalk, alley, park, or other space, except in a restroom or other facility designed for that purpose. The section applies regardless of who owns the property, so a person can violate it on private land visible from the street just as easily as in a city park.

It was adopted as part of Ord. No. 1968 in May 2025, the same ordinance that overhauled Fontana's camping and encampment rules in Article VII of Chapter 16, reflecting the city's broader push that year to address street conditions tied to homelessness and public sanitation. Because Sec. 16-163 sits in the same article as the camping, storage, and vehicle-habitation provisions, Fontana police and code enforcement can pair a public urination or defecation citation with camping or unlawful storage citations when addressing the same encampment or location.

The article's enforcement section makes clear the city can pursue restraining orders, injunctions, or criminal and administrative enforcement in addition to citations, and that resisting or obstructing an enforcement officer is itself a separate violation.
