New Rochelle, NY Public Conduct: Public Urination (2026)

Chapter 256, adopted January 21, 2025 by Ordinance No. 2025-11, defines a Public Pedestrian Plaza as an area designated by the City for pedestrian circulation, use and enjoyment on City-jurisdiction property, including land mapped as a public place or lying within a roadway bed, and which may include amenities such as tables, seating, trees, lighting, bike racks, splash pads or public art. Section 256-2 designates three such plazas: Anderson Plaza near North Avenue and LeCount Place, Memorial Plaza at the northwest corner of Main Street and Memorial Highway, and Garden Street Plaza at the southeast corner of North Avenue and Garden Street.

Among the prohibited uses listed in § 256-4, subsection D bars any person from spitting, urinating or defecating in or on any pedestrian plaza, except in a facility specifically designed for that purpose. That prohibition sits alongside other conduct bans in the same section, including disorderly behavior, littering, bathing or showering, camping, exposing genitalia, and letting an unrestrained dog defecate without cleanup. The chapter's general enforcement provision, § 256-6A, applies uniformly: an offense against the chapter is punishable by a fine of not more than $250 or imprisonment of not more than 15 days, or both, with no escalation built in for repeat violations.
